Acknowledgement of Risk,
Release and Indemnity

1. What I am signing

I am booked on a private cycling journey (the “Journey”) operated by HISHIDA Sports Tours, Kyoto Governor Registered Travel Agency No. 2-247, in partnership with Jimott Inc. — together “JIMOTT”, “the operator”, “they” or “them” in this form. This form is read together with, and does not replace, the Booking Conditions published at exp.jimott.jp/terms/, which I have read and accepted.

In this form “I” and “me” mean the person signing below, and — where the rider is a minor — the parent or guardian signing on that rider's behalf, who accepts every term of this form for themselves and for that rider.

2. I understand the risks

I understand that cycling in Japan is a physically demanding activity carrying risks that cannot be removed without changing the character of the Journey, and that some of those risks may result in serious injury, permanent disability, or death, and in loss of or damage to property. I have read Article B8 of the Booking Conditions and I accept those risks knowingly and voluntarily. They include, without limitation:

• Falls, loss of control, and collisions — with vehicles, pedestrians, other riders, or fixed objects
• Shared roads, junctions, level crossings, bridges and riverside paths used by others
• Uneven, wet, gravel or unsurfaced ground, and obstacles that appear without warning
• Heat, humidity, heatstroke and dehydration; cold, rain, wind and reduced visibility
• Insects, snakes, wildlife and animals along the route
• Mechanical failure of a bicycle, its brakes, tyres or battery, notwithstanding maintenance and the mechanic travelling with the group
• The physical demands of a full day in the saddle, and the aggravation of any condition I already have
• Food and drink to which I may be unaccustomed, including allergens present in kitchens the operator does not control
• Distance from medical care: parts of the route are rural, and a hospital, an ambulance or a specialist may be some way off
• Theft of, loss of, or damage to my own belongings
• The acts and omissions of other road users, members of the public, and third-party suppliers

I understand that the operator cannot guarantee my safety, and that the presence of a guide, a support vehicle, a mechanic or an AED reduces risk but does not remove it.

3. I am fit to ride, and I have told them everything

I confirm that I can ride a bicycle competently and unaided, and that I am in adequate health and physical condition to ride the stated distance — up to about 45km, mostly flat — over a full day in the weather of the season.

I confirm that I have disclosed to the operator, in writing and before departure, every relevant medical condition, injury, mobility limitation, allergy, dietary restriction, pregnancy, cardiac or respiratory condition, and every medication I am taking. I understand that a condition I have not disclosed may make it unsafe for the operator to take me out, that participation may be refused for that reason, and that no refund would be due.

I will carry my own medication with me during the Journey. I authorise the operator to arrange emergency medical treatment or transport on my behalf if I am unable to do so myself, and I accept that the cost of any such treatment or transport is mine.

4. I will follow the rules of the day

• I will wear the helmet provided, correctly fastened, at all times while cycling, and I understand I may not ride without it.
• I will follow the instructions of the guides at all times, and ride within the group as directed.
• I will obey the road traffic law of Japan, and I will not ride after drinking alcohol — a criminal offence in Japan.
• I will observe local custom at temples, shrines and in the neighbourhoods we pass through.
• I will take reasonable care of the bicycle and equipment lent to me, and I accept that I am liable for the cost of repair or replacement if it is lost, stolen while in my keeping, or damaged other than through normal use.

I understand that the operator may, at its sole discretion and on safety grounds, alter the route, ask me to ride in the support vehicle instead of on a bicycle, or end my participation at any point — and that no refund is due if my participation ends for that reason, with any onward cost mine to bear.

5. Insurance

I understand that the domestic travel accident insurance the operator carries for the day is limited: it has fixed benefit limits and does not cover trip cancellation or curtailment, medical evacuation or repatriation, baggage, personal liability, or any cost incurred outside Japan. I understand that any loss beyond its limits is mine to bear or to recover from my own insurer.

I have been strongly advised to hold my own comprehensive travel insurance covering medical treatment in Japan, emergency evacuation and repatriation, personal accident, personal liability, baggage, and cancellation — and to check that it covers cycling as a leisure activity. I take part on that basis, whether or not I hold such a policy.

6. Release and indemnity

In consideration of being permitted to take part in the Journey, and to the fullest extent permitted by the law of Japan:

I release HISHIDA Sports Tours, Jimott Inc., and their directors, officers, employees, guides, drivers, photographers, contractors and agents from all claims, demands and causes of action for loss, damage, injury or death arising from my participation in the Journey — save for liability for death or personal injury caused by their negligence, and any other liability that cannot lawfully be excluded or limited.

I accept that their total liability to me, however arising, is limited to the total price paid for the affected Journey, and that they are not liable for indirect or consequential loss, including missed connecting travel, unused accommodation, lost earnings, or loss of enjoyment of my wider trip.

I indemnify them and hold them harmless against any loss, damage, claim, cost or expense — including legal costs — arising from my own deliberate act, my negligence, or my failure to observe this form, the Booking Conditions, the instructions of the guides, or the law of Japan, including any claim brought against them by a third party in respect of my conduct.

This release binds my heirs, executors, administrators and personal representatives. It is governed by the law of Japan, and the Kyoto District Court has exclusive jurisdiction as the court of first instance over any dispute arising from it. If any part of this form is found unenforceable, the remainder continues in force.

7. Photography and film

I consent to being photographed and filmed during the Journey, and to JIMOTT and Jimott Inc. using the resulting images and footage in marketing — website, social media and print — without further payment, on the terms of Article B12 of the Booking Conditions. Images delivered privately to me for my own keeping are excluded from this consent. I understand I may opt out at any time by writing to experience@jimott.jp.
